Intellectual Property Rights

1. General Provisions
This text regulates the rules regarding intellectual property rights on intellectual products created within the scope of services provided by Blesyum Software and Technology Ltd. ("Blesyum") and digital assets owned by Blesyum.

2. Legal Framework
Intellectual property rights within the scope of this text are protected under the provisions of the following legislation:
- Law No. 5846 on Intellectual and Artistic Works;
- Law No. 6769 on Industrial Property;
- Turkish Commercial Code No. 6102 (unfair competition provisions);
- Law No. 4054 on Protection of Competition;
- International intellectual property agreements to which Turkey is a party (Bern Convention, TRIPS, etc.).
3. Intellectual Property Rights Owned by Blesyum
3.1. Website and Digital Platforms
All intellectual property rights on the following elements located on www.blesyum.com website, accounts.blesyum.com customer panel and all related subdomains belong to Blesyum:
- Website design, user interface (UI) and user experience (UX) designs;
- Source code, software and databases;
- Text, visual, video, infographic and all other content;
- Blesyum logo, brand and other trademarks;
- Blog posts, articles, industry analyses and educational content.
3.2. Blesyum Infrastructure and Tools
Intellectual property rights on the following elements developed by Blesyum and used in customer projects remain with Blesyum independently of the customer project:
- Software libraries, frameworks, templates and code snippets;
- Reusable design components and UI kits;
- Automation tools and scripts;
- CRM, project management and customer panel systems;
- Internal processes, methodologies and workflows.
Note: These infrastructures are licensed to the customer for use within the project scope. However, intellectual property rights do not transfer to the customer.
4. Intellectual Property Rights on Customer Projects
4.1. General Principle
Intellectual property rights on products specifically created for the customer within the scope of customer projects (website, software, graphic design, etc.) are determined according to the provisions of the service contract/proposal.
4.2. Standard Practice (Unless Otherwise Stated in Contract)
- Custom designs: Visual designs (UI/UX, graphics, logos) specially created for the customer are transferred to the customer upon full payment.
- Software code: Custom code developed for the customer is licensed to the customer for use. Copyright remains with Blesyum, customer receives usage rights.
- Content: Original text, photo and video content prepared for the customer is transferred to the customer.
- Third-party components: Components obtained with license from external sources (stock photos, fonts, templates, plugins) are subject to the relevant license terms.
4.3. Pre-Delivery Period
All intellectual property rights on works and draft versions remain with Blesyum during the project period until full payment is made and final delivery is completed. Customer cannot use, publish or transfer these works to third parties without permission.
4.4. Work for Hire
If explicitly stated in the service contract, Blesyum performs the project as "work for hire" and all intellectual property rights are transferred to the customer upon full payment. This arrangement must be clearly stated in writing in the contract and is generally applied to high-budget special projects.
5. Restrictions on Use
5.1. Third Party Transfer
Customer cannot transfer, sublicense or sell projects and works transferred by Blesyum to third parties (without Blesyum's prior written consent):
- Source code and software components;
- Design files and raw design materials;
- Infrastructures, templates and reusable components developed by Blesyum.
5.2. Reverse Engineering
Customer cannot perform reverse engineering, decompiling or similar technical analysis operations on software and systems developed by Blesyum.
5.3. Trademark Use
Customer cannot use Blesyum's name, logo and trademarks without permission. Reference can be made with prior written consent within the scope of reference and portfolio use.
6. Portfolio and Reference Rights
Blesyum has the right to use completed projects in its own portfolio, case studies, marketing materials and promotional activities (website, social media, presentations). This right includes:
- Visual screenshots of the project;
- Technical details and success metrics;
- Customer name and logo (with prior approval).
If the customer does not want to be included in the portfolio, this must be clearly stated in the service contract with an NDA (Non-Disclosure Agreement).
7. Copyright Notices
Blesyum may place copyright notices such as "Developed by Blesyum" or "Design: Blesyum" in the footer or metadata of delivered projects. Removal of these notices requires additional payment or explicit provision in the contract.
8. Intellectual Property Violations
8.1. Blesyum's Guarantee
Blesyum guarantees that works delivered within the project scope do not violate third party intellectual property rights. If a third party claim arises, Blesyum is obliged to resolve the situation or offer an alternative solution.
8.2. Customer's Responsibility
Customer is responsible for not violating intellectual property rights of content, text, photos, logos and other materials provided to Blesyum. Blesyum is not liable for violations arising from customer-provided materials.
8.3. Legal Process
In case of intellectual property violations, Blesyum reserves all legal remedies (cease and desist, removal, compensation) under laws No. 5846 and 6769.
9. Open Source and License Compliance
Open source software (libraries, frameworks) used in projects by Blesyum is used in accordance with their license terms (MIT, GPL, Apache, etc.). Customer must comply with the relevant license terms.
10. Data and Content Ownership
Ownership of data entered and stored by customer on platforms developed by Blesyum (customer panel, CRM, e-commerce site) belongs to the customer. Blesyum only processes this data within the scope of service provision and KVKK compliance.
11. Dispute Resolution
Disputes arising from intellectual property rights are subject to Turkish law. Istanbul Anatolian Courts and Execution Offices are authorized.
